1. Acceptance and Role
By clicking "I agree" you ("Promoter", "you") enter into this Promoter Agreement ("Agreement") with KiteAtlas, the operator of kiteatlas.io ("Platform", "we", "us"). The Agreement is effective May 3, 2026 and governs your activity referring kite schools, hotels, kite safari operators, and any other third-party providers ("Providers") to list on the Platform. The Promoter Agreement is version 1.
2. Compensation
KiteAtlas pays you a commission of ten percent (10%) of the net booking revenue (gross booking value minus refunds and Stripe processing fees) for every confirmed booking on a Provider attributed to you, for a window of 24 months beginning on that Provider's first paid booking on the Platform. After 24 months no further commissions accrue on that Provider.
Your commission rate is locked at the moment of acceptance. KiteAtlas may adjust the default rate for new promoters; the change will not retroactively apply to your account unless you accept a new major version of this Agreement.
3. Attribution Rules
Attribution is first-touch. A Provider is attributed to the Promoter whose referral link they first clicked, sealed at the moment they sign up or are imported into the Platform. Subsequent clicks on other Promoters' links do not change attribution.
The referral cookie is valid for 90 days. If a Provider clicks your link and does not sign up within that window, attribution lapses and the next promoter to refer them may claim the relationship.
Self-referrals — registering yourself as a Provider through your own referral link, or controlling a Provider account that signs up via your link — are prohibited and will be reversed.
4. Payouts
Commissions move through three states:
- PENDING: booking is confirmed but in the Provider's cancellation window. Commission may be reversed if the booking is cancelled or refunded.
- PAYABLE: cancellation window has passed. Commission is payable and queued for the next monthly payout.
- PAID: transferred to your Stripe Connect account.
Payouts run monthly when your PAYABLE balance exceeds 100 USD. Below that threshold the balance accumulates until it crosses. Payment is made via Stripe Transfer to the Stripe Connect account on file.
5. Conduct
You agree to:
- Promote KiteAtlas and its Providers honestly. Do not misrepresent pricing, features, availability, or terms.
- Refrain from spam: do not post in forums where promotion is prohibited, do not blast unsolicited mailing lists, and do not impersonate KiteAtlas.
- Refrain from bidding on "KiteAtlas" or related brand keywords in paid search.
- Refrain from purchasing, selling, or trading referral attribution.
- Comply with all applicable laws on advertising, consumer protection, and data protection.
6. Termination
KiteAtlas may suspend or terminate your access at any time for cause, including violation of conduct rules, fraud, or repeated complaints. Upon termination:
- Earned but unpaid PAYABLE commissions remain owed and will be paid on the next scheduled payout.
- PENDING commissions accrued during the termination period are forfeited.
- Future bookings on attributed Providers do not generate further commission.
7. Independent Contractor
You act as an independent contractor. Nothing in this Agreement creates an employment, joint-venture, partnership, or agency relationship between you and KiteAtlas.
8. Taxes
You are responsible for declaring and paying all taxes on commissions earned. KiteAtlas may issue annual summaries or jurisdiction-specific tax forms (e.g., 1099 in the United States) where required by law.
9. Changes to These Terms
KiteAtlas may publish new versions of this Agreement. Minor updates take effect on publication. Major updates — including changes to your commission rate or attribution window — require your re-acceptance before further commissions accrue.
10. Governing Law
This Agreement is governed by the laws of Mexico. Any dispute will be resolved in the courts of Quintana Roo, Mexico.
By accepting this Agreement, you acknowledge that you have read, understood, and agree to all of the terms above, and that the 10% commission will apply to every attributed booking during the 24-month attribution window for each referred Provider.
