1. Acceptance of Terms

By accessing or using KITEATLAS ("the Platform"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.

2. Platform Description

KITEATLAS is a marketplace connecting kitesurfing enthusiasts ("Riders") with service providers including kite schools, hotels, safaris, and instructors ("Operators"). KITEATLAS facilitates bookings but is not itself a provider of kitesurfing services.

3. User Accounts

  • You must be at least 18 years old to create an account
  • You are responsible for maintaining the security of your account credentials
  • One person per account; accounts are non-transferable
  • You must provide accurate and complete information during registration
  • KITEATLAS reserves the right to suspend or terminate accounts that violate these terms

4. Booking & Payment

4.1 Escrow Protection

All payments are held in escrow through our payment processor (Stripe) until the service is delivered. Funds are released to Operators after the Rider checks in or the service is completed.

4.2 Platform Fee

KITEATLAS charges a service fee on each booking. This fee covers payment processing, insurance facilitation, weather guarantees, and platform maintenance.

4.3 Off-Platform Transactions

Transactions arranged outside the Platform are not covered by KITEATLAS's escrow protection, weather guarantees, or dispute resolution. KITEATLAS strongly discourages off-platform bookings for the safety of both Riders and Operators.

5. Cancellation Policies

Cancellation terms vary by Operator and are displayed on each listing. See our Cancellation Policy page for details including weather-related cancellations.

6. User Conduct

  • Do not share misleading or false information
  • Do not attempt to circumvent the platform's payment system
  • Do not harass, abuse, or threaten other users
  • Do not create fake accounts or reviews
  • Do not scrape, crawl, or data-mine the Platform

7. Content & Reviews

Users retain ownership of content they post but grant KITEATLAS a worldwide, non-exclusive license to display, distribute, and promote such content. Reviews must be honest and based on genuine experiences.

8. Liability & Disclaimer

Kitesurfing is an inherently risky sport. KITEATLAS does not guarantee safety and is not liable for injuries, accidents, or damages arising from kitesurfing activities booked through the Platform. Users participate at their own risk.

9. Dispute Resolution

In case of disputes between Riders and Operators, KITEATLAS provides a mediation process. Both parties agree to participate in good faith before seeking external resolution.
